creoviva Terms of Service

Draft v1.0 · Effective date: TBD · Last updated: TBD

These Terms govern use of the creoviva website, applications, creator pages, messaging, live sessions, video services and related features (the "Platform"). creoviva is a technology platform, not the publisher of creator content: each approved creator has their own individual public page on which they make available their own sessions and videos. The creator is responsible for the content and services offered through their page, subject to these Terms and applicable law. creoviva does not itself create or publish that content.

1. Operator

The Platform is operated by Ember Eagle Ltd, a company incorporated in England and Wales. Registered office: 71-75 Shelton Street, WC2H 9JQ London, United Kingdom. Company number: TBD. Legal contact: TBD. Safety contact: TBD.

2. 18+ eligibility

3. Zero tolerance for illegal content

The following are strictly prohibited. creoviva may immediately restrict access, remove content, suspend or terminate accounts, preserve evidence and disclose information to competent authorities where required or permitted by law.

4. Child sexual abuse material and law-enforcement reporting

creoviva has a zero-tolerance policy toward CSAM and child exploitation. If we detect, receive a credible report about, or otherwise become aware of suspected CSAM or related criminal conduct, we may immediately restrict the material/account, preserve relevant evidence and report or disclose it to the appropriate law-enforcement, child-protection or other competent authority as required or permitted by applicable law.

The reporting destination depends on the jurisdiction and circumstances. creoviva will not promise that every report is sent to a particular national police force. Where UK reporting duties apply, reports may be made through the applicable UK specialist reporting channel. Where EU or other national obligations apply, the appropriate authority or mechanism will be used.

Users must not download, copy, forward or redistribute suspected CSAM. Report it through the Platform and follow the instructions provided.

5. Creator content

Content made available by creators through their creoviva creator pages is provided, controlled and owned by the creator, not by creoviva.

6. Live sessions

Live sessions are normally one-to-one. creoviva may interrupt or terminate a session where there is a safety, legal, consent, fraud or policy concern. Recording, screenshots or redistribution may be restricted by the Platform and may also be unlawful depending on the circumstances.

7. Customer payments

Where direct creator payment is used, the customer pays the creator directly to the creator's designated bank account. creoviva does not hold or settle that customer payment on the creator's behalf. The creator is responsible for verifying receipt and for applicable tax and legal obligations.

8. Credits and platform fees

9. Moderation and enforcement

creoviva may use human review, automated tools, user reports and security signals to identify potentially illegal or prohibited content made available through creator pages. We may remove or restrict content, suspend accounts, restrict messaging/uploads/sessions, preserve information, respond to lawful requests and report suspected criminal conduct where required or permitted.

Where applicable law requires notice-and-action, complaints or appeals, creoviva will provide the relevant mechanism.

10. Reporting illegal content

Users may report suspected illegal content or conduct using the "Report illegal content" link available on every creator page. Reports should identify the relevant profile/content/conversation and explain the concern. Do not redistribute suspected CSAM when making a report.

11. Intellectual property

Creators retain rights in content they lawfully own. By uploading content, creators grant creoviva the limited licence necessary to host, process, transmit, display, moderate, secure and technically deliver it on their creator page. creoviva retains rights in its software, branding and Platform.

When a customer purchases a video, they receive a personal, non-transferable licence to view that video for their own private use. The creator remains the copyright owner. The customer must not copy, download outside the Platform's own player, screen-record, redistribute, publish, resell, or upload the video (or any part of it) to any other service. Purchased videos may be watermarked with the buyer's account details and purchase reference for traceability. A breach of this clause is a copyright infringement and a breach of these Terms, and may result in account suspension, legal action by the creator or creoviva, and takedown requests against any platform hosting the redistributed copy.

12. Privacy

Personal data is processed according to the creoviva Privacy Policy.

13. Suspension and termination

creoviva may suspend or terminate access for breach of these Terms, applicable law, safety requirements, age requirements, fraud rules or where continued access creates a legal, security or safety risk.

14. Liability

creoviva is a technology platform and does not guarantee the identity, conduct, legality, quality or availability of independent creators or customers. Nothing excludes or limits liability that cannot lawfully be excluded.

15. Governing law

These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections applicable to the user's country of residence.
